The Sports Desk LLC (“TSD”) is a marketing services company which delivers online advertising on behalf of clients, such as advertising agencies and brands themselves. The purpose of this Privacy Policy is to outline (1) how we use your information to deliver targeted and other advertisements on the web, and (2) the privacy practices for information we collect on this website (http://sportsdeskmedia.com). TSD observes the Self-Regulatory Principles for Online Behavioral Advertising set forth by the Digital Advertising Alliance (“DAA”) (as set forth at www.aboutads.info) and, in conjunction with our partner Varick Media Management, partners with Evidon to manage our opt-out process. You may always opt-out of our targeted online advertising services by following the instructions in Section 5 below entitled “Opting Out of Targeted Advertising”, visiting the DAA consumer opt-out page at www.aboutads.info/choices, visiting our opt-out page at www.sportsdeskmedia.com/opt-out or visiting our partner’s opt-out page at www.varickmm.com/opt-out. TSD uses a range of ad serving and pixel serving technologies, which come into contact with a user’s computer through an Internet browser. When our technologies recognize a user’s computer, we may serve an advertisement based upon that computer’s past online behavior. For example, if you have visited a website that sells shoes, we may serve you advertisements for shoes. Our service recognizes the activities of the particular computer’s Internet browser, not a particular user. 2) CONSUMER INFORMATION COLLECTION AND USE BY THE SPORTS DESK THROUGH ITS SERVICES: At no point in the delivery of an ad does TSD collect personally identifiable information such as name, address, phone number or email address. However, you may choose to voluntarily provide such information to an advertiser through their advertisement or website. When you provide information to an advertiser, TSD is not involved in such transaction and you should carefully read the privacy policy of such advertiser to understand how your information will be used. TSD does collect certain non-personally identifiable information through the use of cookies and pixels (described further below) when you come into contact with our clients’ advertisements. This anonymous data may include web browser type (e.g. Mozilla Firefox or Microsoft Internet Explorer), computer operating system (e.g. Microsoft Windows), geographic location as inferred from IP address, search queries previously entered on third party websites, websites visited, and other information that does not specifically identify you. This information is based upon the activities of the computer’s Internet browser. It is sometimes called “clickstream” data. We use this non-personally identifiable information collected from a computer to serve relevant ads to that computer based upon its browsing history. We may share this non-personally identifiable information with third party companies to match it against other data sets, including advertiser customer files. Despite our best efforts, if we ever inadvertently collect personally identifiable information through our service, we will not knowingly use such personally identifiable information in connection with our advertising targeting services. 3) HOW INFORMATION IS STORED: “Cookies” are small files that may be placed on your computer by a service for the purpose of facilitating and enhancing your communication and interaction with that service. We use cookies to collect non-personally identifiable information about the use of a computer’s Internet browser and to store information on the computer so that we may serve targeted advertisements, collect and analyze statistics about the performance of the advertisements and otherwise customize our services and website. You may configure your browser to disable the placement of cookies or to delete them from your computer. 4) DATA RETENTION: We do not proactively set expiration dates on our cookies. However, due to the nature of cookie deletion and browser refreshes, cookies are typically deleted by a user (such as through a Norton or McAfee program) or are flushed from the browser within 30 days. For certain campaigns, we employ recency settings on our cookies such that they expire after a specific period of time for the purpose of keeping the cookie current. 5) OPTING OUT OF TARGETED ADVERTISING: Users who wish to opt-out of cookie-based ad targeting by TSD can do so by one of the following methods: (i) Visiting our own opt-out page at www.sportsdeskmedia.com/opt-out. We will then store an ‘opt-out’ cookie on your computer to indicate to us that you no longer wish to see targeted advertising and we will no longer collect non-personally identifiable information from your computer for such purposes. However, you may still see advertisements served by us. These advertisements will no longer be targeted based upon your online behavior. We will also continue to collect and use non-personally identifiable information for statistical and reporting purposes, but not for targeting. When you delete your cookies, change browsers or use a different cookie, our cookie (or an opt-out cookie) may no longer work and you will have to revisit the Evidon website to opt-out again. 6) OPTING OUT OF OUR USE OF YOUR PERSONALLY IDENTIFIABLE INFORMATION: If you would like us to stop using your personally identifiable information collected through this website, please send us an email at privacy@sportsdeskmedia.com, and we will process your request within a reasonable time after receipt. 7) SECURITY: We understand that security is an important aspect of any data collection practice. Therefore, we have put in place and shall maintain reasonable physical and electronic security to try to prevent unauthorized access to, or use of, your information. However, as an Internet-based business, we are unable to control every aspect of data collection or use and cannot guarantee that unauthorized access or use will never occur despite our reasonable efforts. 8) CHANGES TO THIS PRIVACY POLICY: We reserve the right, at our discretion, to change, modify, improve, clarify, or remove portions from this Privacy Policy at any time. Please check this page periodically for changes. Your continued use of this website following the posting (with reasonable notice) of changes to these terms will mean you accept and agree to be bound by those changes. Information collected prior to the time any change is posted will be used according to the rules and laws that applied at the time the information was collected. However, if at any time in the future we plan to use personally identifiable information in a way that materially differs from this Privacy Policy, such as sharing such information with more third parties, we will post such changes here and provide you the opportunity to opt-out of such differing uses. 9) DATA STORED IN UNITED STATES OF AMERICA: Our servers are maintained in the United States of America. By providing use with any of your information, you freely and specifically give us your consent to export your information within the United States and to store and use it within the United States as specified in this Privacy Policy. 10) CHILDREN: Although this website is accessible by persons of all ages, we do not knowingly collect or solicit personally identifiable information from children under the age of 13, except as permitted by law. If we discover that we have received any information from a child under the age of 13 in violation of this Privacy Policy, we will delete that information immediately. If you believe we have any information from or about anyone under the age of 13, please contact us at the address in Section 13 listed below.

Further, We will never collect personal information from children under 13. Without limiting the generality of the foregoing, children will never be asked to provide names, addresses, hobbies or any other information that would enable anyone to identify a particular child;

  • The Site will not disclose any information collected from children to any third parties;
  •  Parents of children have the option to consent to the collection and use of their child’s information without consenting to the disclosure of the information to third parties;
  • We will not require a child to disclose more information than is reasonably necessary to participate in an activity as a condition of participation;
  • Children are strongly encouraged to tell their parents about any information that they have provided to this website or any other site; and
  •  Parents of children can review their child’s personal information, ask to have it deleted and refuse to allow any further collection or use of the child’s information. Should a parent elect this option, that parent can contact us at the address listed in Section 13 below.

11) CALIFORNIA PRIVACY RIGHTS: TSD is exempt from the provisions of California’s Civil Code Section 1798.83 pursuant to subsection (c)(1) as TSD is a business with fewer than 20 full-time or part-time employees). 12) This Privacy Policy shall be governed by and construed in accordance with the laws of the State of Illinois as applied to agreements entered into and to be fully performed within the State, without regard to its conflicts of law provisions. You hereby agree that any cause of action you may have with respect to TSD and/or this website must be filed in a federal or state court located in Chicago, Illinois within 180 days of the time in which the events giving rise to such claim were know or should have been known to you, or you agree to unconditionally waive such claim. You agree no such claim may be brought as a class action. If for any reason any provision of this Privacy Policy is found unenforceable, that provision shall be enforced to the maximum extent permitted by applicable law and the remainder of this Privacy Policy shall continue in full force and effect. Any failure or refusal of TSD to enforce or exercise any right arising under or related to this Privacy Policy shall not constitute a waiver of that right or the ability to enforce such right or provision at any time in the future.
